Medicare Set Aside Proposals

The Federal Government has mandated that adequate funds be placed aside for payment of future allowable medical expenses for Medicare patients, or those that will be Medicare-eligible within 60 months of their date of settlement.

The Secondary Payer Act essentially places Medicare in the second payer role, as any medical expenses related to a liability, work comp or other claim should be paid by the responsible party.

Settlement of certain liability, work comp and auto claims require the prepataion of a Medicare Set Aside proposal that may need to be approved by Medicare at the time of settlement, ensuring that the proper level of funds has been retained for the future care of the Claimant(s) in question.
